Casino Apps Legal States Guide 2026: Where Can You Play for Real Money?
The single most important question any American player needs to answer before downloading a casino app and depositing real money is this: is it actually legal where you are? The good news is that the legal landscape for online casino gaming in the US is expanding. The not-so-good news is that real money casino apps are still only available in a relatively small number of states — and the rules vary more than most people realise. Here is everything you need to know, as of April 2026.
The Short Answer
Real money online casino apps are currently legal in eight US states. If you live in — or are physically located in — one of those states, you can legally download a licensed casino app, deposit real money, and play for real cash prizes. If you are not in one of those states, real money casino apps are not legally available to you through regulated channels.
There is an important distinction worth understanding upfront: you do not need to be a resident of a legal state to play. You simply need to be physically present within the state’s borders at the time of play. All licensed casino apps use geolocation technology to verify your location in real time — so if you travel to New Jersey for the weekend, you can legally play at a New Jersey-licensed casino app, even if you live in Texas.
The Eight Legal States — As of April 2026
Connecticut
Connecticut legalised online casino gaming as part of a broader gaming expansion deal with its two tribal gaming operators — the Mashantucket Pequot Tribal Nation (Foxwoods) and the Mohegan Tribe (Mohegan Sun). As a result, the state operates a more restricted market than most, with only two licensed casino operators available:
- DraftKings Casino — operating under a licence via Foxwoods
- FanDuel Casino — operating under a licence via Mohegan Sun
The minimum gambling age in Connecticut is 21.
Delaware
Delaware was one of the first US states to legalise online gambling, doing so back in 2012 — a year before New Jersey. However, Delaware’s market is the most limited of any legal state. All online casinos available in Delaware operate under the Delaware Lottery’s iGaming platform. The options are limited, but the state is fully legal and regulated. BetRivers Casino is among the operators available in Delaware. The minimum gambling age is 21.
Maine
Maine became the eighth US state to legalise online casino gaming in January 2026, when Governor Janet Mills allowed bill LD 1164 to pass into law. Under the legislation, the state’s four federally recognised Wabanaki Nations tribes — the Mi’kmaq, Maliseet, Penobscot, and Passamaquoddy — hold exclusive rights to online casino licensing, with each tribe permitted to partner with a single third-party operator.
Two important caveats apply here. First, the law does not take effect until July 2026, ninety days after the state House session ends, and the Maine Gambling Control Unit has indicated that a realistic launch date for live apps is early 2027 — not 2026. Second, Churchill Downs (owner of Oxford Casino) has filed a federal lawsuit challenging the tribal-exclusive licensing structure as unconstitutional, arguing it violates equal protection laws. The outcome of that litigation could affect the timeline and structure of the Maine market. DraftKings and Caesars are among the operators expected to launch in Maine when the market eventually opens, as both already have tribal partnerships in place.
The minimum gambling age in Maine is 21.
Michigan
Michigan is one of the most competitive and well-developed online casino markets in the US, having launched in January 2021. The state allows up to 15 online casino licences and all positions are currently filled, giving Michigan players more operator choice than almost anywhere else in the country. All the major operators are present — BetMGM, DraftKings, FanDuel, Caesars, BetRivers, Golden Nugget, and more.
The minimum gambling age in Michigan is 21.
New Jersey
New Jersey launched legal online casino gaming in November 2013 and remains the largest, most established, and most competitive online casino market in the United States. With close to 30 licensed operators, New Jersey players have more choice than anywhere else in the country, and the state consistently offers the most generous bonuses and the widest game selections. If you are based in New Jersey, you are in the best possible position in the US for regulated online casino play.
The minimum gambling age in New Jersey is 21.
Pennsylvania
Pennsylvania launched online casino gaming in July 2019 and has grown into one of the top three markets in the country alongside New Jersey and Michigan. The state has a competitive operator landscape with all major brands present. Pennsylvania is worth noting for having one of the highest iGaming tax rates in the US — something operators factor into their bonus structures, which is why welcome offers in PA are sometimes slightly less generous than in other states.
The minimum gambling age in Pennsylvania is 21.
Rhode Island
Rhode Island is the newest and smallest of the fully operational legal casino states, having launched online gaming in March 2024. It is also the most restricted — currently operating as a monopoly market, with Bally’s Corporation holding the exclusive licence to offer online slots and live dealer table games. While the choice is narrow compared to states like New Jersey or Michigan, Rhode Island players can access fully regulated, licensed real money casino apps through the Bally Casino app or website.
One important note on minimum age: while Rhode Island’s land-based casinos permit entry from age 18, the minimum age for online casino play in Rhode Island is 21. This is a deliberate policy decision made at launch, in line with the majority of regulated US online casino markets.
West Virginia
West Virginia legalised online casino gaming in 2019 and launched its first sites in 2020. The Mountain State has multiple licensed online casinos operating, including all the major brands — DraftKings, FanDuel, BetMGM, Caesars, and BetRivers among them. West Virginia is also notable for typically offering the most generous welcome bonuses in the country — BetMGM’s deposit match, for example, goes up to $2,500 in West Virginia compared to lower caps in other states.
The minimum gambling age in West Virginia is 21.
States Where Casino Apps Are Not Yet Legal — But Worth Watching
The legal landscape is genuinely moving, and several states are actively working towards legalisation. Here is where the most significant developments stand as of April 2026.
Virginia
The Virginia Senate passed SB118 in early 2026 following an initial rejection and reconsideration. The bill still requires House approval to become law, and as of April 2026 its fate remains uncertain. Virginia is one of the more likely next markets to open if the legislation advances, though no confirmed timeline exists yet.
New York
New York has the largest population of any state with a competitive sports betting market, and pressure to legalise online casinos is growing steadily. Senator Joseph Addabbo has reintroduced iGaming legislation for 2026. Most industry observers expect New York to legalise online casino gaming within the next few years — though timeline predictions have been repeatedly revised. Note that New York also banned sweepstakes casino operators in December 2025, meaning New York residents currently have no legal online casino options of any kind.
Illinois
Illinois has seen iGaming bills filed for its 2026 legislative session, including HB 4797. Passage in 2026 is considered unlikely, but the conversation is progressing. The state remains one to watch over the next two to three years.
Maryland, Massachusetts, Indiana, and Florida
All four states have seen varying degrees of legislative activity around online casino legalisation. None are expected to launch in 2026, but each bears watching as the national landscape continues to evolve.
What About the Other States?
For players in states where real money casino apps are not currently legal, there are two main alternatives worth understanding.
Sweepstakes Casino Apps
Sweepstakes casinos operate under a different legal model — one that allows them to be available in most US states without requiring a state gaming licence. Instead of wagering real money directly, players use virtual currencies — typically Gold Coins for fun play and Sweeps Coins that can be redeemed for real cash prizes. This model is available in approximately 45 states. I cover the best sweepstakes casino apps separately on this site.
However, sweepstakes casinos are not universally available. Three states have now banned them: California banned dual-currency sweepstakes casino operators effective January 1, 2026; New York banned sweepstakes casinos in December 2025; and Washington state has long prohibited sweepstakes gaming. If you are in any of these three states, sweepstakes casinos are not a legal option.
Sports Betting Apps
Online sports betting is currently legal in 38 or more states — a far broader reach than casino apps. If you are in a state where casino apps are not available, a regulated sports betting app may still be accessible to you.
The Critical Rule — Location, Not Residency
Your legal eligibility to play at a real money casino app depends on where you physically are, not where you live. Residency is irrelevant. What matters is your physical location at the moment of play, which all licensed apps verify in real time using geolocation technology. This means:
- A Texas resident travelling to Michigan can legally play at BetMGM Casino while in Michigan
- A New Jersey resident physically in Ohio cannot legally play at their New Jersey casino account while in Ohio
- Using a VPN to fake your location is a violation of every licensed casino app’s terms and conditions and may result in account closure and forfeiture of funds
What Happens if I Play at an Unlicensed Offshore Casino?
Offshore casino websites accepting US players operate outside US regulatory oversight. They are not licensed by any US gaming authority, your funds carry no legal protection, and disputes have no regulatory resolution process. I strongly recommend sticking to licensed, regulated operators. The regulated market has expanded significantly and continues to grow — the short-term inconvenience of waiting for your state to legalise is far preferable to the risks of playing at an unregulated platform.
