Delaware

Maine

Maine became the eighth US state to legalise online casino gaming in January 2026, when Governor Janet Mills allowed bill LD 1164 to pass into law. Under the legislation, the state’s four federally recognised Wabanaki Nations tribes — the Mi’kmaq, Maliseet, Penobscot, and Passamaquoddy — hold exclusive rights to online casino licensing, with each tribe permitted to partner with a single third-party operator.

Two important caveats apply here. First, the law does not take effect until July 2026, ninety days after the state House session ends, and the Maine Gambling Control Unit has indicated that a realistic launch date for live apps is early 2027 — not 2026. Second, Churchill Downs (owner of Oxford Casino) has filed a federal lawsuit challenging the tribal-exclusive licensing structure as unconstitutional, arguing it violates equal protection laws. The outcome of that litigation could affect the timeline and structure of the Maine market. DraftKings and Caesars are among the operators expected to launch in Maine when the market eventually opens, as both already have tribal partnerships in place.

Michigan

Michigan is one of the most competitive and well-developed online casino markets in the US, having launched in January 2021. The state allows up to 15 online casino licences and all positions are currently filled, giving Michigan players more operator choice than almost anywhere else in the country. New Jersey

Virginia

The Virginia Senate passed SB118 in early 2026 following an initial rejection and reconsideration. The bill still requires House approval to become law, and as of April 2026 its fate remains uncertain. Virginia is one of the more likely next markets to open if the legislation advances, though no confirmed timeline exists yet.

New York

New York has the largest population of any state with a competitive sports betting market, and pressure to legalise online casinos is growing steadily. Senator Joseph Addabbo has reintroduced iGaming legislation for 2026. Most industry observers expect New York to legalise online casino gaming within the next few years — though timeline predictions have been repeatedly revised. Note that New York also banned sweepstakes casino operators in December 2025, meaning New York residents currently have no legal online casino options of any kind.

Illinois

Illinois has seen iGaming bills filed for its 2026 legislative session, including HB 4797. Passage in 2026 is considered unlikely, but the conversation is progressing. The state remains one to watch over the next two to three years.

Maryland, Massachusetts, Indiana, and Florida

All four states have seen varying degrees of legislative activity around online casino legalisation. None are expected to launch in 2026, but each bears watching as the national landscape continues to evolve.

What About the Other States?

For players in states where real money casino apps are not currently legal, there are two main alternatives worth understanding.

Sweepstakes Casino Apps

Sweepstakes casinos operate under a different legal model — one that allows them to be available in most US states without requiring a state gaming licence.
